PokerOS is software for running poker tournaments. Two kinds of people use it and these terms cover both: ORGANIZERS, who run a club and its games, and PLAYERS, who register for those games. Where a clause applies to only one, it says so.
01What PokerOS is, and what it is not
PokerOS is a tool an organizer uses to run their own games: a clock, seating, a chip count, payouts and a record of what happened. PokerOS does not run games, hold player funds, set buy-ins, decide payouts, or take a share of any prize pool. Those are the organizer's decisions and the organizer's responsibility. We supply the software; the club supplies the game. Nothing in PokerOS is a gambling service. Whether a particular game is lawful where it is held is a question for the organizer and their local law, not for us.
02Accounts
ORGANIZERS sign in with an email address and a password. You are responsible for what happens under your account, including anything done by staff you invite to your club. PLAYERS sign in with a phone number and a PIN. That phone number identifies you to every club you play at, which is how a desk finds your registration. A PIN is not a password: keep it to yourself, and change it in your profile if you think someone else has it. DEALER TABLETS pair with a short code and hold no account. A dealer session can edit chip counts at the table it is paired to and nothing else. You must be old enough to take part in the games you register for, under the law where they are held. An organizer may ask you to prove it.
03What an organizer is responsible for
If you run a club on PokerOS, you are responsible for: the lawfulness of your games where you hold them; the accuracy of what you publish about them; the money, in whatever form it takes, including collecting buy-ins and paying prizes; the conduct of your staff and your room; and the personal data of your players, for which you are the controller and we are a processor. You choose what to publish. An event or a series is private until you list it, and a link or QR code keeps working either way.
04What a player agrees to
Register honestly. Use your own phone number and give the name a club will recognise at the desk. A registration is between you and the club, not between you and PokerOS. Buy-ins, refunds, disputes about a result, and anything else about the game itself go to the club running it. We can show you what the software recorded; we cannot overturn a floor decision.
05Credits and payment
Organizers pay for PokerOS in credits, or on a plan. Card payments are handled by Stripe; we do not see or store your card number. Credits are consumed when a series is created and are not refundable once used. Unused credits do not expire. A plan runs for its term and does not auto-renew without telling you first. We may change prices. A change never applies to a term you have already paid for.
06Acceptable use
Do not use PokerOS to break the law, to run a game you are not permitted to run, to impersonate a club or a person, to scrape or resell the data of other clubs, or to interfere with the service for anyone else. We may suspend a club that does. Where we can, we will say why and give you a chance to fix it first; where the law or someone's safety does not allow that, we will not.
07Your data, and getting it out
The records a club creates belong to that club. Export is available from the report screen as CSV at any time, and does not require an active plan. If you close a club we will delete its data within 90 days, except anything we must keep for accounting or legal reasons. Ask us and we will tell you exactly what that is in your case.
08Availability
We try to keep PokerOS running and we do not promise it always will. A tournament clock is worth having a paper backup for. We deploy changes during quiet hours where we can, and we will tell you before anything that requires downtime.
09Liability
PokerOS is provided as it is. To the extent the law allows, we are not liable for lost profit, lost prize money, a mis-seated table, a clock that ran fast, or any other loss arising from your use of the software. Where liability cannot be excluded, it is limited to what you paid us in the twelve months before the claim. Nothing here limits liability for fraud, or for anything else that cannot lawfully be limited.
10Changes, and the law that applies
We may update these terms. Material changes are announced in the app before they take effect, and the date at the top of this page always says when it last changed. These terms are governed by the laws of Thailand.
